How it works in New South Wales

A new swimming pool in New South Wales generally needs approval before you dig, either through a Complying Development Certificate (CDC) if the pool meets the relevant standards under the Codes SEPP, or through a Development Application (DA) to council followed by a Construction Certificate (CC) from a certifier. Once the pool is built, an Occupation Certificate is not usually the trigger for a stand-alone pool, but the pool barrier still has to comply, and it has to be registered on the NSW Swimming Pool Register.

If you already have a pool and you are selling or leasing the property, you will need a valid Certificate of Compliance for the pool barrier. This certificate is valid for three years, and it confirms the fencing, gates and surrounds meet the required safety standard. Vast can inspect an existing pool barrier and issue this certificate, or assess a new pool as part of its building approval.

We inspect the pool and barrier at the relevant stages, including the completed barrier before the pool is filled or used.

Certificate and registration

We issue the Certificate of Compliance (or the relevant building certificate for new work) and confirm the pool is on the NSW Swimming Pool Register.

Fence and gate height, and the gaps that let a small child squeeze through or climb over
Self-closing and self-latching gates, tested to make sure they actually work
Climbable objects near the barrier, such as pot plants, furniture or low branches
The line of sight from the house and whether a boundary fence can be used as part of the barrier
Distances between the pool, the barrier and any doors or windows that open onto the pool area
Warning signage where required
Whether the pool is correctly listed on the NSW Swimming Pool Register

Do I need council approval for a new pool in Sydney?

Most pools can go through a Complying Development Certificate with a registered certifier rather than a full council Development Application, provided the pool meets the relevant standards under the Codes SEPP. We can tell you which path applies once we see your plans.

How long is a pool compliance certificate valid?

A Certificate of Compliance for a pool barrier is valid for three years from the date of issue. You will need a current certificate to sell or lease a property with a pool.

What happens if my pool barrier fails inspection?

We will tell you exactly what needs to change, whether it is a gate that does not self-latch, a gap that is too wide, or a climbable object too close to the fence. Most issues are straightforward to fix, and we can reinspect once the work is done.

Is my pool on the Swimming Pool Register?
